On 06/04/2025 at 9:36 PM, I, Officer Albert Gee assigned to West 6 was dispatched to the front of Foundry on Elm for a male that needs help. Dispatch stated it was the same male we spoke with earlier on 44 Chester St.
I arrived on scene and spoke with Mr. XXXX again. He said he had complications from his dialysis treatments and smoked some weed. He says he normally takes breaks when he walks because he gets exhausted. He said when he gets tired he leans on walls and his head hangs a bit. He said it makes him look like he needs help but he is ok. I offered to walk with him to the Davis Sq bus station because he was heading home to Arlington. He agreed and we walked together.
We walked east on Elm St, north on Grove St, and took a left on the MBTA Busway. Mr. XXXX was walking slow because of his condition and we let numerous people walk by us. I noticed another person walk behind us and we separated. Mr. XXXX walked a bit to his left and I walked to my right so the person could walk between us and continue to the Bus station at his walking pace. The person/Mr. Elijah Steres passed us in the middle, abruptly turned around and spit a large amount of spit between us. Mr. XXXX and I were approximately 2 feet apart. Mr. XXXX shouted out, "What the hell." I felt spit on the left side of my face and eye. The spit got on the left part of my uniform and left arm. I contacted Somerville Control and asked for another unit, someone spit on me, and I'm off at the Davis T stop.
I approached Mr. Steres and I ordered him to stop and he did. I told him he was under arrest for assault and battery. Mr. Steres had a bewildered look on his face and asked why. I told him he spit on me and I ordered him to the ground. Mr. Steres did not comply and I took out my department issued pepper spray and I ordered him again to get on the ground. Mr. Steres remained standing and questioned me if I was going to spray him for spitting.
MBTA Officer McDonough unit B418 arrived on scene. We grabbed Mr. Steres arms and turned him around and put him on the vent grates by the bike rack. We put his hand behind his back and I cuffed his right wrist. I attempted to cuff his left wrist but he grabbed the handcuff and wouldn't let go. Officer Derek Dottin, Officer Guerdy Legros, and Officer Keighla McAloney arrived on scene. Officer Dottin was able to help us hand cuff Mr. Steres and I contacted control for the prisoner transport. He was transported to the Somerville Police Station and booked.
Officer McAloney spoke with Mr. XXXX. He said, "It was completely unprovoked. He turns and spits and it hit me in the eye and I felt the wet." "Some of that foam shit him me in the eye and a big loogie hit him"
Somerville Fire arrived on scene. I washed my eyes and face with sterile water and dried it with gauze. Mr. XXXX cleaned his eye and face with the water Fire provided. Mr. XXXX refused transport to the hospital. I was transported to the Cambridge hospital and was checked for exposure.
I am charging Mr. Steres with A&B, A&B PO, and Resisting Arrest.
