On Monday, September 1, 2025, I, Officer Jonathan Martins, was in full uniform and assigned to Marked United East-4 for my 12:00 AM to 8:00 AM shift. At approximately 2:08 AM, I was dispatched to 10 Jaques St for reports of a male party hitting cars. East-1 Officer Ryan Sullivan responded as backup.
Upon my arrival, I was met by the reporting parties/victims, XXXX and XXXX (SIBLINGS). They described the male party as a light-skinned black male with dreads wearing a black jacket and loafer-like shoes. XXXX stated that around 2:00 AM, he woke up to a noise that sounded like metal grinding on cement. He then looked outside his window, facing the backyard, and noticed the above-described male jumping over their fence into the backyard. He also noticed that the male party had a metal pole in his hand. XXXX immediately went to notify his family in the home. This prompted XXXX to enter one of the bedrooms facing the backyard. XXXX stated that when she entered the bedroom with an open window, she observed the male party standing on a bench located outside, underneath the window of that room, and that the male party was trying to pull himself up through the open window. XXXX further mentioned that the male party was struggling to pull himself up, which gave her enough time to shut the window. At this point, both XXXX and XXXX stated that the male party went to their driveway and started kicking their driveway gate while screaming "THIS IS MY UNCLE'S HOUSE" with the metal rod in his hands. The party then walked down Wheatland St towards Broadway, where they lost sight of him. Before searching the area for the male party, I did not see any damage to the motor vehicles parked on the street. Both XXXX and XXXX realised that the metal pole the male party had was from their driveway gate, which is used to secure it. It should be noted that XXXX did not speak fluent English; however, XXXX was able to translate parts of the conversation from Spanish to English.
Approximately 8 minutes later, I located a male party matching the exact description inside Dumpling Garden (273 Broadway); the male party was still in possession of the metal pole. When I entered Dumpling Garden, the male party was identified as Magnuson VIEIRA (familiar to Officers due to past incidents), who was telling the employee to let him "order his food or else I am going to go back there myself to do it." I immediately made myself known and, due to VIEIRA's behavior and matching the description of the suspect, I grabbed his right arm and took the metal pole from his possession. I informed VIEIRA that he is detained due to a pending investigation and that he matches the description of a suspect. VIEIRA immediately tensed up and said that he had done nothing except try to order food. I told VIEIRA to put his hands behind his back and that we can talk about this outside. VIEIRA refused to put his hands behind his back and began pulling away. VIEIRA ended up sitting on a chair while still pulling away from me. At this point, VIEIRA grabbed onto the collar of my vest and started pushing me back. Officer Sullivan ran into Dumpling Garden, and we were able to push VIEIRA outside the establishment. I told VIEIRA to let go of my vest, that he is under arrest, and to put his hands behind his back. VIEIRA refused and continued his resistive behaviour. VIERA was brought to the ground and was placed into handcuffs. Officer Sullivan sustained a hand injury due to VIEIRA falling onto his hand during arrest. Officer Sullivan was transported to Cambridge Hospital due to having a swollen and bleeding hand. At this point, all other units responded on scene.
When I was explaining the initial response to another unit, VIEIRA overheard us speaking and suddenly yelled, "I did not hit any cars, I just pushed the side windows in with my hand". VIEIRA was transported to the Somerville Police Station by Unit 200 (Officer Radochia), where Lt. Anderson booked him.
I returned to 10 Jaques St with the metal pole. Both XXXX and XXXX stated that the pole I had was the one taken from their fence, and that one they had seen the male party have in his possession. Due to the victims' request for possession of the pole to secure their driveway, and it appearing that the pole was not an object used to commit a crime, the pole was returned to the victims. They secured their gate with the pole. Photos of the pole and the unsecured driveway gate will be attached to the report.
It should be noted that I returned to Dumpling Garden to request footage from inside the store; however, the employee XXXX stated that their cameras do not record. XXXX observed my initial contact with VIEIRA.
Due to the above, VIEIRA will be charged with:
- 265/13D/A A&B ON POLICE OFFICER c265 S13D (2 counts)
- 268/32B RESISTING ARREST c268 S32B
- 274/6 ATTEMPT TO COMMIT CRIME (B&E)
