Narrative: During the past few months in the Davis Square area, the Somerville Police Department has received numerous 911 calls about illicit drug use in the area. Areas such as Statue park and Seven Hills park have seen an increase in drug use and citizens who live in the area have even placed signs on different street lights and trash bins discouraging the use. Due to this, the Somerville Police department established a plain clothes Unit, consisting of a supervising Officer and two patrol Officers. This unit was designed to conduct surveillance of the area and ensure the safety and tranquility of the community. Within the past few days alone, several arrests have been made involving the use of narcotics. Recently, their have been complaints of prostitution and human trafficking occurring within the Seven Hills Park portable toilets. This Unit is expected to conduct walking patrols and identify individuals who engage in illicit substance abuse.
About 7:45PM on Wednesday 06/17/26, I Officer R. Westgate on a Plain Clothes assignment in the Davis Square area as Unit CG3, was walking through Seven Hills park for surveillance purposes. As I walked down a set of concrete steps heading towards Meacham Road (at the bend) where a crosswalk is, I observed several males, some standing, others sitting in a small grass area with what appeared to be an Electrical Box near them. I then observed one of the males place a glass pipe close to his face and I could hear what sounded like a lighter being lit to the bottom of the glass pipe. While lighting said pipe, the male had one hand blocking the side of his face and his head down. At the time, he was facing down towards the electrical box, making it more difficult to view from the sidewalk. More so, the corner the males were standing in is a more secluded area with a fence behind them and away from the public. From my training and experience in the Davis Square Area, I believed the male to be smoking an illicit substance due to the significant drug use increase, usage of a glass smoking pipe, in a secluded area and hiding his face as well as looking down while lighting the pipe.
I then called Units CG2 with Officer R. Pasqualino and CG1 with Sergeant (SGT) Devin Schneider for assistance. These Units are also apart of the plain clothes assignment. While I waited, I observed the male who smoked out of pipe blow some sort of smoke cloud out of his mouth. He then lowered the glass pipe from his mouth.
When Officer Pasqualino in CG2 and SGT Schneider in Unit CG1 arrived on scene, we then approached the several individuals and identified ourselves as Somerville Police Officers. SGT Schneider then explained that we are searching the area for illicit drug use and that I observed one of the males smoking from a glass pipe. The individual who I saw smoking was identified as XXXX. XXXX explained that he was hanging out in the area. After a search of his persons, he did not have any illicit substance on him.
Before asking any further questions, a male who was sitting down (later identified as Christopher Lapointe,) stated he had a glass smoking pipe on him. More so, that he has a needle on him that may or may not contain a substance. Upon searching his right pant leg pocket he had a capped needle (more than half depressed/ at the 3ML mark) that has a brown like substance inside. Due to my training I believed this to possibly be heroin. Also on his persons in his pant leg pocket was a Glass Pipe with a white stain all around the circular smoking end of the pipe, along with burn marks on the bottom. Due to my training I believe this to be the remnant of crack cocaine use. Christopher Lapointe (Lapointe,) also had a lighter. Lapointe explained that he had been specifically smoking crack but usually smokes it in a wooded area. Throughout the encounter with Lapointe, he was very honest and cooperative. However, due to having two different illicit substances on his persons, he was placed into handcuffs.
Within feet of Lapointe was two different bags, one to his immediate right and the other several feet behind him within throwing distance. While conducting an investigation on Lapointe, a female (later identified as Kayla Osgood,) entered the area and walked behind the group of males on scene. Kayla Osgood (Osgood,) then picked up the bag behind Lapointe and began walking away. Due to the suspicion of drug paraphernalia being inside and being close to Lapointe, I asked if she could drop the bag and leave the area of the investigation. Osgood ignored this command, and began walking towards Meacham RD stating it was "her bag," and she just wanted to "leave." I then instructed her to drop the bag again and she became belligerent and stated that I just wanted to look through a "woman's bag." More so, she was acting aggressive throughout the encounter with her, she eventually dropped the bag and walked several feet away.
Due to Osgood's behavior and entering the scene during a clear investigation with several Somerville Police Officers. Additionally the bag being within the area and positive find of two separate substance abuse items, I believed she had illicit substances inside of her bag. More so, Osgood was in the area before we approached the group of males and was watching from the beginning of the initial approach. As I searched deeper into the bag, I saw lighters and more glass pipes with burnt residue on the bottoms. As time went on, I slowly took items out of the bag and placed it beside the bag as a means to fully search the bag. As I got to the bottom I saw a folded piece of paper. When I took the piece of paper out of the bag, it was the wrapping of a narcan plastic container and inside were several small pieces of white shiny rock. From my training and experience and when I showed SGT Schneider my findings, we believed this to be crack cocaine.
Not long after, Osgood was placed into handcuffs and the bag that she had on her persons was taken off. The bag was a cross body pouch that contained several more capped needles and several tea light metal caps, within the caps were burnt residue. Also in the bag were more glass pipes that had burnt residue on the bottom.
Also on scene was XXXX who was in close proximity to Lapointe. He stated he did not have any illicit substance on him and was searched by other Officers on scene. XXXX was found not to have anything on his persons and was released. More so, a separate male who I did not see smoke but was near Lapointe and XXXX was released after being identified by Officer McCune.
With several illicit substances found, Unit 200 (transport wagon) was called to transfer Osgood and Lapointe back to the Somerville Police Station for the booking process. At the station, both Osgood and Lapointe were booked by Lieutenant Capasso and explained their Miranda rights and charges.
All Evidence will be entered into safe and logged.
Lapointe is charged with the following,
MGL CH 94C/34/C - Possession of a class B Substance (burnt glass smoking pipe with a white like layer around the bottom end and throughout the tube believed to be remnants of Crack Cocaine)
MGL CH 94C/34/A - Possession of a Class A Substance (Brown like substance in a needle believed to be Heroin)
Osgood is charged with the following,
MGL CH 94C/34/C - Possession of a class B Substance (small white rock substance believed and stated to be crack Cocaine)
