On Tuesday, April 29th, 2025, I, Officer Lorizio, was in full uniform and assigned to marked unit East-1 for the 12am- 8am Shift. At approximately 1AM I responded to the Capital One Cafe for a check condition. Officer Kartso (E4) responded as well.
Once on scene, a male later identified as Mr. John VICTOR was sitting down inside the ATM vestibule. I attempted numerous times to ask him if he was okay and needed any assistance. VICTOR continued to stare blankly ahead and ignored all of my attempts to speak, he then stood up and attempted to use the ATM, still ignoring my attempts to speak with him. At this time E4 arrived, and we both attempted to speak with VICTOR. His demeanor all of a sudden changed and he began screaming at us, making incoherent statements. VICTOR kept screaming at us that myself and E4 did this to him 5 years ago. We attempted to explain to him we were not employed as police officers 5 years ago. VICTOR was pacing around the vestibule screaming at us, and multiple times got face to face with us. For Officer safety reasons, we ordered Victor to back up in an effort to create distance between us and him. For approximately 10 minutes we attempted to de-escalate VICTOR, but he kept screaming he would not spend the night outside. I explained to him numerous times we can work with him to find a suitable place for him to spend the night. VICTOR then picked up an approximately 4-foot-tall trash can and began waving it around, eventually throwing it at the ground a few feet in front of myself and E4. At this time I requested dispatch to send another unit due to the escalating violent behavior of VICTOR. We ordered VICTOR once more to leave the vestibule and that he was being trespassed.
A few minutes later Officer Ruf (SE) and Officer Martins (E3) arrived on the scene, we ordered VICTOR to grab his belongings and that we would be escorting him out of the vestibule. SE attempted to walk behind VICTOR, that is when VICTOR shoved Officer Ruf in the upper torso knocking him off balance. Officers then attempted to restrain VICTOR, but due to his resistance, he was stood up against the wall. VICTOR used his left arm and struck my chin and latched onto the collar of my ballistic vest and attempted to pull me down. I ordered him to let go multiple times, and unsuccessfully attempted to free myself from his grip. Due to Victor actively resisting our efforts to place him in custody, along with the fact he was attempting to pull me to the ground by my vest collar, I delivered approximately 4 closed fist strikes to the face area of VICTOR. The strikes broke his grip and I was able to assist officers with getting VICTOR to the ground. Once VICTOR was proned out on the ground he refused to comply with orders to give us his hands and continued to resist. As a distraction technique, I utilized 3 knee strikes to the left rib area of VICTOR. Officers were eventually able to place VICTOR in handcuffs and double-lock them.
I then requested Unit 200, the prisoner transport wagon. Officer Bitencourt arrived and transported VICTOR back to Somerville Police Headquarters located at 220 Washington St, where he was booked in the usual manner by Lt. Capasso.
I will be charging VICTOR with:
